Your rights as a Queensland tenant

Queensland rental law protects you. Here are the key rights every tenant should know.

Right to Quiet Enjoyment

Your home is your home. Housit can only enter your property for specific reasons and must give proper notice. Inspections require 7 days notice. Maintenance requires 24 hours notice. Entry is only permitted between 8am and 6pm Monday to Saturday unless you agree otherwise.

Right to a Well-Maintained Property

Your landlord is required to maintain the property in a condition that meets Queensland's minimum housing standards. This includes working smoke alarms, secure locks, functioning utilities, and protection from weather. Report issues to us and we will act.

Rent Increase Protections

Rent can only be increased at the end of a fixed-term lease or once every 12 months on a periodic lease. You must receive at least one month's notice on a fixed-term lease, or two months' notice on a periodic tenancy. If you believe an increase is excessive, contact us.

Bond Protections

Your bond of four weeks rent is lodged with the RTA, not held by us. It can only be claimed against unpaid rent, damage beyond fair wear and tear, or cleaning issues. At the end of your tenancy, if the property is in good order, you will receive your full bond back promptly.

Protection from Unfair Eviction

You cannot be evicted without proper grounds and proper notice. During a fixed-term lease, a Notice to Leave can only be issued for specific breaches. On a periodic tenancy, two months notice is required without grounds. The process must follow Queensland tenancy law exactly.

Right to Request Repairs

You have the right to request repairs and maintenance, and your landlord is obligated to respond. Emergency repairs must be actioned immediately. Non-urgent repairs must be addressed within a reasonable timeframe. Keep records of all requests in writing.

Tenant FAQs

Rent can only be increased at the end of a fixed-term arrangement or once every 12 months on a periodic tenancy. You must receive at least one month's notice on a fixed-term lease or two months notice on a periodic tenancy. If you feel an increase is excessive, contact us and we are happy to discuss it.
Your bond of four weeks rent is lodged with the RTA at the start of your tenancy. When you move out, you apply to the RTA to have it returned. Provided the property is in good condition and rent is up to date, you will generally receive it within days of your final inspection. If there is a claim against the bond, the RTA will notify you and you have 14 days to respond.
On a fixed-term lease you need to give two weeks notice before the end date if you do not wish to renew. On a periodic (rolling) tenancy you must give two weeks notice at any time. Always put your notice in writing and keep a copy. Contact us before giving notice so we can guide you through the process.
Contact us immediately before the rent falls due. If we know in advance we can often work with you on a plan before any formal process begins. Once rent is 7 days late we are required to issue a Notice to Remedy Breach under Queensland law. It is always better to communicate early. Call us on 1800 955 180.
We can only enter your home for specific purposes and must always give notice. Routine inspections require 7 days written notice. Maintenance and repairs require 24 hours notice. Entry is only permitted between 8am and 6pm Monday to Saturday unless you agree to a different time. We respect your home and your privacy.
Everyone who lives in the property as a long-term resident should be named on the lease. Each person on the lease is jointly responsible for rent and the condition of the property, and will share in the bond return. If your living arrangements change, contact us to update the lease. Do not sublet without written permission.
At the end of a fixed-term lease there are three options. You can agree to a new fixed-term lease, you can move out by giving two weeks notice, or the tenancy can continue as a periodic (rolling) arrangement which can be ended at any time by either party giving the required notice. We will contact you in advance of the end date to discuss your options.
Under Queensland's current tenancy legislation, landlords cannot unreasonably refuse a pet request. You should submit a pet request in writing before bringing a pet to the property. We will seek the owner's approval and respond with any conditions. Having a pet without approval is a breach of your lease, so always ask first.
